Terms of Service

1. Agreement to Terms

By accessing or using the GolfTraQ platform, software, hardware, and associated pureblack telemetry network (collectively, the "Services") provided by Akita Engineering ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Services.

2. Use of the Services

You may use the Services only for lawful business purposes related to golf course operations, fleet tracking, and pace of play management. You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the GolfTraQ software or hardware.
• Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services.
• Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services.
• Resell, sublicense, or otherwise distribute the Services without express written consent from Akita Engineering.

3. Subscription Tiers and Payments

Akita Engineering offers both a "Standard" (self-hosted, subscription-free) and "Pro" (cloud-hosted, subscription) tier. Users of the Pro tier agree to pay all applicable subscription fees as outlined in their service agreement. Failure to maintain active payment may result in the suspension or termination of cloud-hosted Services. SLAs and priority support apply only to users on the GolfTraQ Pro tier.

4. Intellectual Property Rights

The Services, including but not limited to the GolfTraQ dashboard, pureblack network telemetry protocols, source code, functionality, software, website designs, audio, video, text, photographs, and graphics, are owned or licensed by Akita Engineering and are protected by copyright and trademark laws of Canada and foreign jurisdictions.

5. Limitation of Liability

In no event will Akita Engineering, or its directors, employees, or agents, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

6. Governing Law

These Terms of Service and your use of the Services are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
